Roe v. Wade Has Been Overturned

But abortion is still safe, legal, and accessible in Florida. 

The Supreme Court has overturned Roe v. Wade — the court's landmark decision that established the right to abortion nearly 50 years ago. This decision means the legality of abortion will be determined on a state by state basis — opening the door for states to ban abortion entirely. 

We are here to tell you: Abortion is still safe, legal, and available in Florida today, and Planned Parenthood is providing care.

Is abortion still legal in Florida?

Yes. Here in Florida, abortion is still legal and you can still access abortion care.

Is self-managed abortion legal in Florida?

No. It is illegal in Florida for anyone other than a doctor to perform an abortion.

Is abortion safe?

Yes, abortion is a safe and effective way to end a pregnancy. The abortion bans being passed have nothing to do with patient health or safety.  

Millions of people face unplanned pregnancies every year, and about 4 out of 10 of them decide to get an abortion. 

Serious complications from abortion are really rare. Having an abortion doesn’t increase your risk for breast cancer or affect your fertility. It doesn’t cause problems for future pregnancies or pose any risk to your overall health.  

How does the overturning of Roe v. Wade affect the ability to get an abortion in Florida?

Abortion is still safe, legal and accessible up to 15-weeks of pregnancy in Florida. 

The overturning of Roe means that there is no longer at right to abortion at the national level, and each state can regulate, and even ban, abortion within the respective state. In Florida, our constitution’s strong right to privacy has consistently been interpreted to protect your right to an abortion. 

How does the  15-week abortion ban affect the ability to get an abortion in Florida?

Abortion is still safe, legal and accessible up to 15-weeks of pregnancy in Florida. 

A 15-week ban for our state went into effect on July 1, 2022. We have joined other providers across the state in a lawsuit to fight to overturn the Florida law on the basis of its unconstitutionality. 

As always, PPSWCF will comply with the law, even when we believe it to be unjust and unconstitutional. We remain focused on providing safe, comprehensive care to as many patients as possible and we will continue to follow the law and assess the shifting litigation moment by moment to ensure we are providing care as we can.

What exceptions exist for the 15-week abortion ban?

The law allows for limited exceptions if carrying the pregnancy to term would result in serious injury or death for the mother, or if the fetus has a fatal abnormality. There are no exceptions for pregnancies caused by rape or incest. 

Planned Parenthood of Southwest and Central Florida will comply with all laws and regulations while the 15-week ban is implemented we will connect patients with our Patient Navigator to coordinate their care out of state.

Is the Florida 15-week abortion ban legal?

We believe our strong right to privacy guaranteed in the Florida Constitution makes HB 5 (the 15-week abortion ban) unconstitutional, regardless of the status of Roe v. Wade. That's why we have joined other providers across the state in a lawsuit to fight to overturn the Florida law. 

On June 30, 2022 a court indicated that they will issue an injunction (an order to stop) against the state’s 15-week abortion ban. While this is only a first step in fighting this dangerous abortion ban, we are grateful this court recognized that it is an unconstitutional intrusion on our patients’ and providers’ medical decisions. I need to get an abortion, can I still come to Planned Parenthood?

Yes, in Florida abortion is still legal for everyone up to 15-weeks, after that there are very limited exceptions. However, now that the US Supreme Court has overturned Roe v. Wade, that may change in the future. In Florida, we believe our strong right to privacy guaranteed in the Florida Constitution makes HB 5 (the 15-week abortion ban) unconstitutional, regardless of the status of Roe, and that the law should be overturned - which is why we filed a lawsuit against HB 5 on June 1st.

What is Planned Parenthood doing about this?  

We will continue to provide you with information about where to get abortion care because your health and well-being are our highest priority, no matter where you live. 

This is what we're doing to address this now: 

  • We will continue to explore all options. We have filed a lawsuit to stop the 15-week ban based on our strong statewide right to privacy. We will keep this page updated on the status of these laws and what they mean for you. 

  • All of our health centers are open and providing care to ensure that patients have access to safe, legal abortion and the full spectrum of sexual and reproductive health care. Our healthcare team has been working to increase access to services to meet the needs of our patients.    

  • We are working in partnership with other Planned Parenthoods and independent abortion providers throughout the state and country to help patients get abortion care however we can.
